An ordinance providing regulations governing subdivision of land within the corporate
limits of the City of Starkville, Mississippi; providing the procedure for the administration
thereof; establishing plat requirements, required improvements, and design standards;
providing for variances; and for related purposes.
Whereas, the board of aldermen of the City of Starkville, Mississippi, acting under
authority granted by MCA 1972, § 17-1-3 et seq., as amended, has taken action heretofore
to provide for the preparation, adoption, amendment, extension and carrying out of
an official comprehensive and/or master plan, in whole or in part, for the purpose
of bringing about coordinated physical development of said City of Starkville in accordance
with present and future needs; and has created and established heretofore, a city
planning and zoning commission, to serve without pay, with authority to prepare and
propose (1) a master plan of physical development of the said City of Starkville,
Mississippi, or part thereof; (2) a proposed zoning ordinance and map; (3) regulations
governing subdivision of land; and (4) building or setback lines on roads and highways;
and,
Whereas, the said city planning and zoning commission has prepared and proposed to
the board of aldermen of the City of Starkville (1) a master plan of physical development
of the said City of Starkville, Mississippi, or part thereof; (2) a proposed zoning
ordinance and map; (3) regulations governing subdivision of land; and (4) building
or setback lines on roads and highways; and,
Whereas, the board of aldermen of the said City of Starkville, after a public hearing
called and held thereon as provided by MCA 1972, § 17-1-15, as amended, has adopted
heretofore an official comprehensive and/or master plan of physical development of
the City of Starkville, Mississippi, that is based upon the proposals as submitted
to the said board of aldermen by the said city planning and zoning commission; and,
Whereas, the said city planning and zoning commission subsequently has submitted and
proposed to the said board of aldermen for adoption regulations governing subdivision
of land within the corporate limits of the City of Starkville, Mississippi, and which
said regulations are based upon and in accordance with the official comprehensive
and/or master plan of physical development adopted by the said board of aldermen heretofore;
and,
Whereas, the said board of aldermen has called and held a public hearing on the said
proposed regulations governing subdivision of land within the corporate limits of
the said City of Starkville in the manner and as provided by MCA 1972, § 17-1-15,
and at which said public hearing parties in interest and citizens were given the opportunity
to be heard and were heard; and,
Whereas, the regulations governing subdivision of land within the corporate limits
of the City of Starkville, Mississippi as [are] set forth in this ordinance as based
upon and made in accordance with the said official comprehensive and/or master plan
of physical development of the said City of Starkville adopted by the said board of
aldermen heretofore; and are designed to assist orderly, efficient, and coordinated
development within the City of Starkville; to promote health, safety and general welfare
of the residents of Starkville and its environs; to facilitate the adequate provision
of transportation, water, sewerage, schools, parks and other public improvements;
and to secure equitable handling of all subdivision plans by providing uniform procedures
and standards for observance by both subdividers and the city planning and zoning
commission;
Now, therefore, be it ordained by the mayor and board of aldermen, from and after
the date of adoption of these regulations, that these regulations shall govern all
subdivision of land within the corporate limits of the City of Starkville, Mississippi.
